Additional Elaboration on Policies
FORCE MAJEURE
1. Definition
Buna Studio (“BUNA”, “we”, “our”, “us”) shall not be liable for any failure, delay, interruption, suspension, or inability to perform its obligations under any order or agreement if such failure or delay results from events beyond our reasonable control (“Force Majeure Event”).
Force Majeure Events include, but are not limited to:
- War (declared or undeclared), armed conflict, invasion, military action
- Civil unrest, riots, political instability
- Terrorist acts
- Government orders, trade restrictions, sanctions, embargoes
- Natural disasters (earthquake, flood, cyclone, drought, etc.)
- Fire, industrial accidents
- Epidemics or pandemics
- Lockdowns or public health restrictions
- Border closures or customs restrictions
- Supply chain disruptions
- Labour shortages or artisan unavailability
- Transportation interruptions
- Courier or logistics suspension
- Power outages or infrastructure breakdown
- Any event beyond our reasonable commercial control
⸻
2. Effect on Orders
In the event of a Force Majeure Event:
- Production timelines may be extended.
- Shipping timelines may be delayed.
- Delivery commitments may be temporarily suspended.
-
Communication timelines may be affected.
Orders already:
- In production
- In tailoring or finishing stage
- In packaging or logistics stage
- Booked with courier
-
In transit
Cannot be cancelled or refunded, as:
- Materials may have been cut or customized.
- Labour costs have already been incurred.
- Production resources have been allocated.
- Logistics and documentation expenses may have been paid.
- Such costs are non-recoverable.
⸻
3. Suspension of Obligations
During a Force Majeure Event:
- Our contractual obligations shall be temporarily suspended.
- Performance shall resume once operations reasonably normalize.
-
We shall not be considered in breach of contract during such period.
⸻
4. No Liability for Delay
BUNA STUDIO shall not be liable for:
- Indirect losses
- Consequential damages
- Financial losses due to delayed delivery
-
Event-based losses (including weddings, travel, ceremonies, or other occasions)
Delay caused by Force Majeure shall not constitute grounds for:
- Cancellation
- Refund
- Compensation
- Chargeback claims
⸻
5. Priority Dispatch
Once operations resume:
- Orders will be processed in sequence.
- Delayed orders will be prioritized.
-
Customers will be notified of revised timelines.
⸻
6. Acceptance of Risk
By placing an order with BUNA, the customer acknowledges and agrees that:
- BUNA operates under a handcrafted, make-to-order production model.
- Production begins soon after order confirmation.
- External geopolitical, environmental, or logistical disruptions are beyond BUNA’s control.
- Cancellation or refund is not possible for orders already in production or logistics phase due to Force Majeure.
⸻
7. Severability
If any part of this Force Majeure clause is found unenforceable under applicable law, the remaining provisions shall remain valid and enforceable.
⸻
CHARGEBACK PROTECTION & PAYMENT DISPUTE POLICY
1. Agreement to Contact Us First
By placing an order on www.bunastudio.com, you agree to contact BUNA directly at:
care@bunastudio.com
+91 9310164266 (Call/WhatsApp)
before initiating:
- A chargeback
- A payment dispute
- A PayPal claim
- A credit/debit card dispute
- Any banking reversal request
We are committed to resolving concerns in good faith and within a reasonable time.
⸻
2. No Chargebacks for Production-Stage Orders
You acknowledge and agree that:
- BUNA operates on a made-to-order model.
- Production begins shortly after order confirmation.
- Once an order status changes to “Processing,” irreversible costs are incurred, including:
- Fabric allocation or cutting
- Hand weaving or dyeing
- Embroidery or stitching
- Labour commitments
- Production overhead
Accordingly:
Chargebacks are not valid grounds for orders that are:
- In production
- In finishing stage
- Packed or shipped
- Delayed due to Force Majeure
- Delayed due to logistics or customs issues beyond our control
⸻
3. No Chargebacks for Delays
Delivery timelines are approximate.
Delays caused by:
- Hand-intensive production
- Artisan processes
- Courier issues
- Customs clearance
- War, natural disaster, or geopolitical disruption
- Non-availability of customer
-
Refusal to pay customs duties
do not constitute non-delivery or fraud.
Initiating a chargeback in such cases will be considered a breach of agreed purchase terms.
⸻
4. Evidence Submission in Case of Dispute
In the event of a payment dispute, BUNA reserves the right to submit the following evidence to the payment processor or bank:
- Order confirmation
- Customer IP address
- Billing & shipping details
- WhatsApp/email communication records
- Production records
- Courier booking confirmation
- Tracking details
- Delivery attempt proof
-
Policy acceptance at checkout
This evidence will demonstrate fulfillment of contractual obligations.
⸻
5. Fraudulent or Malicious Chargebacks
If a chargeback is initiated:
- After production has commenced,
- After shipment has been dispatched,
- After delivery has been attempted,
-
Or contrary to the policies agreed at checkout,
BUNA reserves the right to:
- Dispute the chargeback with full evidence
- Recover administrative and dispute fees
- Block the customer from future purchases
- Initiate recovery proceedings where applicable under Indian law
⸻
6. Custom & Duty Refusal
Failure to pay international customs duties does not constitute cancellation.
If a customer refuses delivery due to customs charges and initiates a chargeback:
- Return freight
- Indian import duties on return
- Administrative costs
may be claimed as recoverable losses.
⸻
7. Payment Gateway Protection
All transactions are processed through secure, PCI-compliant gateways (Payglocal / Razorpay Secure / PayPal).
By completing payment, the customer:
- Confirms authorization of the transaction.
- Confirms acceptance of our Shipping, Cancellation, Refund & Force Majeure policies.
- Waives the right to initiate a chargeback inconsistent with these policies.
8. Good Faith Resolution Commitment
We are an ethical, slow-fashion brand working with artisan communities.
We encourage customers to reach out to us directly for any concern. Most issues can be resolved quickly without involving financial institutions.
